To be eligible for registration, a trademark must be distinctive—meaning it cannot directly describe the goods or services it is intended to cover. In addition, the trademark must not create a likelihood of confusion with an already registered trademark.
Before submitting a trademark application, it is important to carefully define the goods and services the trademark is intended to cover. Once the application has been submitted, additional goods or services cannot be added.
A trademark remains valid for 10 years after registration and can be renewed indefinitely in 10-year increments.
